Thank you for using the SingStat Mobile Application (this Application). By accessing and using any part of this Application, you agree to be legally bound by these Terms of Use. If you do not agree to these Terms of Use, please do not use this Application.

General

These Terms of Use may be changed from time to time, with or without notice to you. Your use of this Application after such changes have been made shall constitute your agreement to be bound by the revised Terms of Use. Please read these Terms of Use carefully whenever you access or use any part of this Application, as such access or use shall constitute your agreement to the prevailing Terms of Use.

For the purposes of these Terms of Use:

"Contents" means the information made available in this Application, including statistical data, charts, graphs, and documentation;

"Datasets" means statistical data comprised in the Contents;

"Parties" means you and the Government, and "Party" means any one of them; and

"Statutory Board" means a body corporate established by or under written law to perform or discharge any public function under the supervisory charge of a ministry or organ of state.

Proprietary Rights

This Application is owned and operated by the Department of Statistics ("DOS"), a department of the Ministry of Trade and Industry in the Government of the Republic of Singapore (the "Government", "we", "our" or "us").

This Application includes content provided by the Government and Statutory Boards.

The Contents are protected by copyright, trademark and other forms of proprietary rights.

Save to the extent provided for in 'Conditions of Use', you shall not have any right, title or interest in or to any intellectual property in any of the Contents. The title to all intellectual property in the Contents shall be owned by the Government.

Privacy

In the course of your access and use of this Application, we may be required to collect, use, disclose or process personal data belonging to you, or that may relate to a third party individual and is provided by you. In this regard, we will collect, use, disclose and process your personal data in accordance with our privacy policy (the "Privacy Policy").

Please refer to our Privacy Policy for more details. By using this Application, you hereby acknowledge that you have read and understood our Privacy Policy, and that you agree to the terms of the Privacy Policy for this Application as may be amended from time to time. The Privacy Policy forms part of these Terms of Use.

Conditions of Use

Subject to these Terms of Use and your continued compliance with these Terms of Use, we grant you a free, worldwide, revocable and non-exclusive right to use the Contents for the purpose of:

  1. copying, distribution or transmission of the Contents; and

  2. using the Contents to develop or derive, for sale or otherwise, any products and services or to resell the Contents in any form to any third party,

provided that you:

  1. credit the source of the Contents;
  2. use the Contents in a way that is legal and in accordance with all applicable laws;
  3. ensure that no analysis or transformation of the Contents is presented in a manner which suggests or is likely to lead to the belief that the analysis or transformation of the Contents is attributed to the Government or any Statutory Board;
  4. cease to use the Contents and remove them from your applications and websites immediately upon our request, in the event that any part of the Contents is no longer provided in this Application or in the event that you have breached these Terms of Use;
  5. ensure that any reproduction of the Contents is accurate; and
  6. do not use the Contents in a way that suggests the Government or any Statutory Board is associated with you or that the Government or any Statutory Board endorses you or your use of the Contents.

Use of Datasets made available through this Application is subject to the terms of the Singapore Open Data Licence as amended from time to time ("ODL"), which can be found at https://data.gov.sg/open-data-licence. To the extent there is any inconsistency between the terms of the ODL and these Terms of Use, the terms of the ODL shall prevail.

Subject to your continued compliance with these Terms of Use, you may grant a sub-licence of the Contents to the extent such sub-licence is necessary to enable users of your application or website ("your Sub-Licensees") to use your application or access your website. If your Sub-Licensees require additional rights, you must provide information in your application or website directing your Sub-Licensees to obtain the appropriate licence from DOS.

You must not, and must not authorise or permit any third party to, do any of the following:

  1. bypass or circumvent, or attempt to bypass or circumvent, any technical restrictions or digital protection measures in the Application, including by jailbreaking; or

  2. reverse engineer, decompile, disassemble, modify, translate, adapt or create derivative works of any of the Contents (whether in relation to its source code, object code, underlying structure, ideas, algorithms or otherwise).

Changes to the Application

DOS may update this Application from time to time, and may change any of the Contents at any time. However, the Government is under no obligation to update the Contents of this Application.

Disclaimer of Warranties and Liability

The Contents are provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by law, we do not make any representations or warranties of any kind whatsoever in relation to the Contents and hereby disclaim all express, implied and statutory warranties of any time to you or any third party, whether arising from usage or by operation of law or otherwise, including but not limited to any representations or warranties:

  1. as to the accuracy, correctness, completeness, currency, reliability, availability, timeliness, interoperability, security, non-infringement, title, merchantability, quality or fitness for any particular purpose of the Contents; and
  2. that the Contents or any associated functions therewith will always be available or uninterrupted or error-free, or that defects will be corrected or that this Website and the server are and will be free of all viruses and other harmful elements.

Neither the Government nor any Statutory Board shall be liable to you or any third party for any damage or loss of any kind (including loss of profit or any indirect or consequential losses), whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising directly or indirectly under or in connection with:

  1. the use of, or inability to use, the Application;
  2. the use of or reliance on any of the Contents; or
  3. any inaccuracy or incompleteness in, or errors or omissions in, any of the Contents.

DOS may suspend, withdraw, discontinue or change all or any part of this Application without notice. DOS shall not be liable to you if for any reason this Application is unavailable at any time or for any period. DOS has the right to modify or withdraw all or any of the Contents at any time for any reason whatsoever.

Indemnity

You agree to fully indemnify the Government and Statutory Boards at all times against all liabilities, losses, charges, damages, costs (including legal costs) and expenses which the Government or any Statutory Board may sustain or incur, directly or indirectly as a result of any of the following:

  1. your use of any of the Contents;
  2. your fraud, negligence, misconduct or breach of the Terms of Use; or
  3. any claim made by a third party in connection with any of the Contents.

Access

DOS has the right to deny or restrict access to this Application to any particular person, or to block access from a particular Internet address to this Application, or to withdraw this application at any time, without ascribing any reasons whatsoever.

Breach

If you are in breach of these Terms of Use, all your rights under these Terms of Use shall terminate immediately. The Disclaimer of Warranties and Liability and Indemnity sections, and any other provision of these Terms of Use that expressly or by implication is intended to come into or continue in force after such termination shall survive such termination.

Remedies

The rights and remedies of the Government under these Terms of Use are cumulative and are without prejudice and in addition to any rights or remedies the Government may have at law or in equity. No exercise by the Government of any one right or remedy under these Terms of Use, or at law or in equity shall operate so as to hinder or prevent the exercise by it of any other right or remedy under these Terms of Use, at law or in equity.

Rights of Third Parties

Save for the Statutory Boards, a person who is not a party to these Terms of Use shall have no right under the Contract (Rights of Third Parties) Act 2001 or otherwise to enforce any term of these Terms of Use. A Statutory Board may enforce and rely on these Terms of Use to the same extent as if it were a party. Variation or rescission of these Terms of Use shall not require the consent of any third party.

Severability

If any provision in these Terms of Use is determined to be illegal, invalid or unenforceable, in whole or in part, such provision or part of it shall, to the extent it is illegal, invalid or unenforceable, be deemed not to form part of these Terms of Use and the legality, validity and enforceability of the remainder of these Terms of Use shall not be affected.

Waiver

No failure or delay on the part of the Government in exercising any right under these Terms of Use, or at law or in equity, shall operate as a release or waiver thereof. No waiver of any breach of these Terms of Use shall be deemed to be a waiver of any other or of any subsequent breach. Any waiver granted under these Terms of Use must be in writing and may be given subject to conditions. Such waiver shall be effective only in the instance and for the purpose for which it is given.

Governing Law

These Terms of Use shall be governed and construed in accordance with laws of the Republic of Singapore.

Dispute Resolution

Each Party irrevocably agrees that the courts of Singapore shall have exclusive jurisdiction to settle any Dispute. Each Party irrevocably submits to the jurisdiction of such courts.

SingStat Mobile Application Privacy Policy

The SingStat Mobile Application Privacy Policy (the "Privacy Policy") must be read in conjunction with the Terms of Use that accompany the application service you are requesting from us (the "Service"). In this Privacy Policy, "Public Sector Entities" means the Government and Statutory Boards.

  1. We may request certain types of data from you in connection with your access or use of the Service. The data that may be requested include those identified the Annex (as may be amended from time to time). Your data may be stored in our servers, systems or devices, in the servers, systems or devices of our third party service providers or collaborators, or on your device, and may be used by us or our third party service providers or collaborators to facilitate your access or use of the Service.

  2. In respect of personally identifiable data that is collected:

    1. We may share necessary data with other Public Sector Entities, and third party service providers in connection with the Service, so as to provide the Service to you in the most efficient and effective way unless such sharing is prohibited by law.

    2. We will NOT share your Personal Data with entities which are not Public Sector Entities, except where such sharing is necessary for such entities to assist us in providing the Service to you.

    3. For your convenience, we may also display to you data you had previously supplied us or other Public Sector Entities. This will speed up the transaction and save you the trouble of repeating previous submissions. Should the data be out-of-date, please supply us the latest data.
  1. To safeguard your personal data, all electronic storage and transmission of personal data is secured with appropriate security technologies.

  2. You may withdraw your consent to the collection and disclosure of your data by us with reasonable notice and subject to any prevailing legal or contractual restrictions; however, doing so may prevent the proper functioning of the Service and may also result in the cessation of the Service to you.

  3. The Service may contain links to non-Public Sector Entity sites whose data protection and privacy practices may differ from ours. We are not responsible for the content and privacy practices of these other websites and encourage you to consult the privacy notices of those sites.
